Terms of Use

These Terms of Use ("Terms") govern access to and use of BlueAI Akira ("Akira", "Service"), owned by BlueAI Solutions Ltda., registered under CNPJ No. XX.XXX.XXX/0001-XX ("BlueAI", "we"). These Terms constitute a contract of adhesion under art. 54 of the Código de Defesa do Consumidor (CDC — Law No. 8,078/1990) of Brazil.

1. Acceptance of the Terms

By creating an account or using Akira, you agree to these Terms. If you do not agree, do not use the Service.

By signing up, installing the GitHub App, or accessing any feature of the Service, you declare that you have read, understood, and fully accept these Terms and our Privacy Policy.

If you are using Akira on behalf of a company or organization, you declare that you have sufficient authority to bind it to these Terms. The User declares to be legally capable under art. 1 of the Código Civil (Law No. 10,406/2002) of Brazil.

2. What Akira does (and does not do)

Akira is an automated Pull Request review tool. It reads the code, analyzes it, and comments. It never changes anything in your repository.

What Akira does:

• Receives Pull Request notifications from the repositories you connected.
• Analyzes code changes (diffs) using artificial intelligence models (Google Gemini and Anthropic Claude).
• Publishes comments directly on the Pull Request, on GitHub, with observations about security and quality.

What Akira does NOT do:

• It does not make commits, does not change branches, and does not automatically approve or reject PRs.
• It does not access the repository's complete source code — only the diffs of submitted Pull Requests.
• It does not execute source code in any environment.
• It does not replace human review, automated testing, SAST/DAST tools, or any other security practice.

Akira is an assistant. The final decision to accept or reject a Pull Request is always yours.

3. Your account and responsibilities

You are responsible for your account and everything that happens in it.

• Provide truthful information and keep it up to date, in accordance with art. 14 of the Marco Civil da Internet (Law No. 12,965/2014) of Brazil.
• Keep your access credentials secure and not share them with third parties.
• Notify BlueAI immediately if you suspect unauthorized access to your account.

Each account is personal and non-transferable, except for organizational accounts with appropriate permissions. BlueAI reserves the right to refuse account creation or suspend accounts that violate these Terms.

4. GitHub integration

By connecting Akira to GitHub, you authorize us to receive data from your Pull Requests. Only connect repositories over which you have authority.

By installing Akira's GitHub App, you:

• Authorize BlueAI to access the selected repositories exclusively to read Pull Requests and publish review comments.
• Declare that you have legitimate authorization (as owner, administrator, or authorized person) to grant these permissions.
• Acknowledge that granting improper access to third-party repositories without authorization constitutes a violation of these Terms and may constitute civil and criminal infringement.

We access only the permissions strictly necessary, in observance of the minimization principle (art. 6, III, of the LGPD). You may revoke access at any time by uninstalling the GitHub App in your account or organization settings on GitHub. BlueAI is not responsible for changes to GitHub's APIs or policies that may affect the Service's operation.

5. Plans, payments, and cancellation

We offer free and paid plans. You only pay if you choose a paid plan, and you can cancel whenever you want.

Plans and pricing: the available plans, features, and prices are on Akira's pricing page. All prices are in Brazilian Reais (BRL). Prices may be updated with 30 days' prior notice — the new prices take effect in the next cycle after the notice.

Billing: payments are processed by Stripe, Inc. (PCI-DSS Level 1 certified). Billing occurs at the start of each cycle (monthly or annual). Invoices with failed payment will be retried. If delinquency persists after notification, access to the paid plan may be suspended and the account reverted to the free plan.

Cancellation: you can cancel your plan at any time through the Akira dashboard. Upon cancellation, you retain access to the paid plan's features until the end of the already-paid period, after which your account returns to the free plan. Canceling the plan does not delete your account or your data.

Refund: there is no proportional refund for unused partial periods, except in the cases provided by law: right of withdrawal within 7 days of contracting (art. 49 of the CDC) and Service defect not remedied within 30 days (art. 18, §1, of the CDC).

6. Intellectual property

Your code is yours. The platform and the generated comments are ours. Simple as that.

• Your code: all code submitted for analysis remains exclusively yours. BlueAI does not acquire any rights over your code through use of the Service.
• Limited license: by using the Service, you grant us a limited, temporary, non-exclusive, and revocable license to process the diffs necessary for analysis, including sending them to AI providers.
• Our platform: Akira — interface, brand, texts, algorithms, and prompts — is the property of BlueAI, protected by the Lei de Direitos Autorais (Law No. 9,610/1998) and the Lei de Propriedade Industrial (Law No. 9,279/1996) of Brazil.
• Generated comments: the comments published on your PRs are AI-generated based on your code. You may use, copy, and distribute them freely.
• Aggregated data: we may use aggregated and anonymized data (that does not identify you or your code) to improve the Service, under art. 12 of the LGPD.

7. Limitations of AI analysis

Let's be direct: Akira is useful, but it is not infallible. No AI tool is.

Akira's analysis is generated by artificial intelligence models. By using the Service, you acknowledge and accept that:

• Akira can make mistakes. It may flag issues that do not exist (false positives) or fail to identify real vulnerabilities (false negatives). This is inherent to current AI technology.
• It does not guarantee security. An analysis with no findings does not mean the code is free of vulnerabilities. Akira is an additional layer, not a certification.
• Limited context. Akira analyzes Pull Request diffs, not the complete codebase. Vulnerabilities that depend on broader context, execution environments, or infrastructure configurations may not be detected.
• Third-party models. The AI models (Google Gemini and Anthropic Claude) are provided by third parties and are subject to their respective limitations and updates.
• Does not replace security practices. Akira complements — it does not replace — human review, automated testing, static analysis, pentests, and other security practices.

We continuously improve Akira, but the ultimate responsibility for the security of your code is yours. BlueAI will not be held liable for technical, business, or security decisions made based solely on the analyses generated by the Service.

8. Prohibited use

Use Akira in good faith. Below is what is not allowed.

You agree NOT to use Akira to:

• Connect repositories over which you do not have legitimate authorization.
• Submit third-party code obtained without permission, under an NDA that prohibits sharing, or that violates intellectual property rights.
• Attempt to access data belonging to other users or repositories outside your account.
• Reverse engineer, decompile, or attempt to extract Akira's source code, prompts, or algorithms.
• Intentionally overload the Service or exploit infrastructure vulnerabilities.
• Use the Service to develop a competing product.
• Resell, sublicense, or redistribute access to Akira without written authorization.
• Create fake accounts or manipulate the free plan's limits.
• Violate provisions of the Marco Civil da Internet (Law No. 12,965/2014) of Brazil or its regulating Decree (No. 8,771/2016).

BlueAI reserves the right to suspend or terminate accounts that violate these rules, without prejudice to indemnification for losses and damages.

9. Service availability

We do everything we can to keep Akira up and running, but we do not promise 100% availability.

The Service may be temporarily unavailable due to:

• Scheduled maintenance, communicated in advance whenever possible.
• Emergency maintenance to fix failures or vulnerabilities.
• Force majeure or fortuitous events (art. 393 of the Código Civil).
• Failures of third-party services (GitHub, AI providers, Stripe, cloud infrastructure).

BlueAI will not be liable for losses arising from temporary unavailability, except in cases of willful misconduct or gross negligence. In case of prolonged unavailability for more than 30 consecutive days, you will be entitled to a proportional refund for the affected period (art. 20 of the CDC).

10. Limitation of liability

We take responsibility for what we can control. Below are the legal limits.

To the maximum extent permitted by Brazilian law, and without prejudice to the consumer's non-waivable rights (CDC):

• BlueAI's total liability is limited to the amount paid by the User in the 12 months preceding the event that gave rise to the claim.
• BlueAI will not be liable for indirect, incidental, consequential, or punitive damages, including loss of profits, loss of data, or costs of substitute services.
• BlueAI is not responsible for vulnerabilities not detected by the Service, for decisions made based on the analyses, or for acts of third parties (GitHub, AI providers, Stripe).

These limitations do not apply to: willful misconduct or fraud, intellectual property infringement, liability for a defect in the service (art. 14 of the CDC), or obligations imposed by a court decision.

11. Suspension and termination

You can terminate your account whenever you want. We may suspend accounts that violate the Terms.

On your initiative: request termination through the dashboard or by e-mail. Paid plans are canceled at the end of the current cycle. Remember to uninstall the GitHub App directly on GitHub to revoke permissions. Your personal data will be deleted within 15 days, except for retention required by law (art. 16 of the LGPD).

On our initiative: we may suspend or terminate your account, with prior notice whenever possible, in cases of: violation of these Terms, unresolved delinquency, court order, inactivity for more than 12 months (with 30 days' notice), or discontinuation of the Service (with 90 days' notice and proportional refund).

Suspension or termination does not exempt the User from obligations already incurred, including outstanding debts.

12. Governing law and dispute resolution

These Terms are governed by Brazilian law.

The Código Civil (Law No. 10,406/2002), the CDC (Law No. 8,078/1990), the Marco Civil da Internet (Law No. 12,965/2014), the LGPD (Law No. 13,709/2018), and the Lei de Direitos Autorais (Law No. 9,610/1998) of Brazil apply, as applicable.

We encourage amicable resolution — in most cases, we are able to resolve matters directly and quickly. You may also file complaints on the consumidor.gov.br platform or with the Procons of your domicile, in Brazil.

The court of the consumer's domicile is elected (art. 101, I, of the CDC), when the User is an individual or a microenterprise. In other cases, the court of BlueAI's headquarters, in Brazil, is elected.

13. Changes to the Terms

We may update these Terms. You will be notified.

Material changes will be communicated at least 30 days in advance by e-mail or through the Akira dashboard. If you do not agree with the new Terms, you may terminate your account before the effective date, without penalty. When changes affect processing based on consent, we will request new consent. The updated version will always be available on this page with the date of the last update.
